Acceptance And Eligibility
These Terms are an agreement between you and BuildWithCory, the operator of Thumbtack Command Center. By checking the agreement box or selecting the acceptance control presented during signup or at an account reacceptance gate, you affirmatively accept these Terms and the Privacy Policy. After acceptance, these Terms govern your account, subscription, connector, rules, and use of the service.
You must be at least 18 and able to form a binding contract. If you act for a business or another person, you represent that you have authority to accept these Terms for them. The service is offered for legitimate business use in the United States.
The Service
Thumbtack Command Center is an operations tool that can connect an authorized browser session to a private workspace, sync lead and payment activity, organize customer information, prepare drafts and proposed actions, deliver authorized browser or messaging actions, and provide optional Command, billing, calendar, support, and alert features.
Features can change, pause, or end. Some features require a paid plan, a supported browser, an active provider session, a provider account in good standing, a configured integration, an owner test, or an open provider tab. BuildWithCory can apply reasonable limits to protect the service or comply with provider rules.
Independent Service And No Affiliation
BuildWithCory and Thumbtack Command Center are independent from Thumbtack. The service is not made by, endorsed by, approved by, sponsored by, or affiliated with Thumbtack. BuildWithCory is not a party to your agreement with Thumbtack, does not speak for Thumbtack, and cannot change or waive Thumbtack rules.
Thumbtack and every other connected provider control their platforms, data, fees, access decisions, and terms. References to a provider explain compatibility and do not imply approval.
Account Security
You must provide accurate account information, protect your Command Center login, provider sessions, setup keys, and connected service credentials, and limit access to people you have authorized. You are responsible for actions taken by your authorized users and for promptly removing access that is no longer needed.
Notify BuildWithCory promptly if you suspect an account, device, session, connector token, or credential has been compromised. Do not send passwords, raw cookies, setup keys, or provider secrets through ordinary support messages.
Provider Suspension And Deactivation Risk
Thumbtack and other providers can detect automation, change technical controls, challenge requests, limit access, reduce visibility, suspend an account, deactivate an account, remove data, or end a feature at any time. Connecting this service can create account review or enforcement risk even when you believe your use is proper.
You knowingly accept that provider risk. BuildWithCory does not control, make, prevent, or reverse a provider decision. To the extent permitted by law, BuildWithCory is not responsible for a provider restriction, suspension, deactivation, lost lead, lost account data, provider charge, lost revenue, or inability to access a provider, except to the extent directly caused by BuildWithCory breaching these Terms, acting with gross negligence, or engaging in willful misconduct. Any ordinary breach claim remains subject to the liability limits below.
When a provider restriction is detected, the service can mark the account restricted, revoke the connector token, delete the stored provider session, stop new sync and automation work, and safely cancel unsent queued browser actions. An action that already started can have an uncertain outcome and must be checked directly with the provider. The service will not intentionally bypass a provider restriction.
You must use the in app Disconnect control promptly if a provider limits, suspends, or deactivates your access, or if you lose authority or required consent for the connected account.
Customer Data Responsibilities And Limits
You are responsible for customer and business data placed in the service. You must have a lawful business purpose and all notices, consents, and permissions needed to collect, import, use, contact, and retain that data. You must honor customer opt out requests and keep customer information accurate enough for the intended action.
Do not use the service to store or submit full payment card numbers, bank credentials, government identification numbers, medical records, information about children, passwords, provider secrets in ordinary text fields, or unrelated sensitive data. Do not upload data obtained from an account you are not authorized to use.
You grant BuildWithCory a limited permission to host, copy, process, transmit, and display your data only as needed to provide, secure, support, and comply with law for the service. You keep ownership of your lawful data. The Privacy Policy describes handling and deletion requests.
Approvals And Rule Authorized Automation
A specific action can require manual approval. A workspace owner can also expressly enable a messaging rule that authorizes actions matching the rule until it is disabled or changed. Enabling a rule is an instruction to the service, not advice or a guarantee. You are responsible for the rule, template, audience, schedule, offer, and resulting communication.
Rules are subject to account eligibility, current provider access, customer opt out state, provider tests, data freshness, replay protection, and other safety checks. A changed rule, changed lead, uncertain browser result, provider failure, or restriction can stop an action or require manual review. Refund requests, money decisions, and other sensitive actions can require separate review even when another rule is enabled.
You must supervise automation, review audit records, disable a rule that behaves unexpectedly, and promptly report a suspected unauthorized action. BuildWithCory can disable automation to protect users, providers, or the service.
Prohibited Use
You must not use or attempt to use the service to:
- Access an account, data, or customer record without authority.
- Violate a provider term, law, regulation, court order, contract, or required consent.
- Bypass a provider restriction, security control, access challenge, rate limit, or account suspension.
- Scrape, harvest, sell, resell, profile, or advertise with customer or provider data beyond the service purpose.
- Send spam, deceptive messages, unlawful marketing, harassment, discriminatory content, or a message after an opt out.
- Misrepresent identity, qualifications, licensing, services, prices, reviews, leads, refunds, or account ownership.
- Evade fees, manipulate refunds, create prohibited duplicate accounts, or conceal unlawful activity.
- Probe, disrupt, overload, reverse engineer, introduce malicious code, or compromise the service or another user.
- Share access credentials with an unauthorized person or publish confidential service data.
- Use output as legal, financial, tax, licensing, safety, or professional advice without independent review.
Fees, Renewal, Cancellation, And Refunds
Prices, trial terms, billing periods, taxes, and included features are shown before purchase. If checkout describes a recurring subscription, you authorize Stripe and BuildWithCory to charge the selected payment method at each renewal until you cancel. You are responsible for accurate billing information and applicable taxes.
You can cancel through available billing controls or by contacting support. Cancellation normally takes effect at the end of the paid billing period. Removing the extension, losing provider access, or having a provider account suspended or deactivated does not automatically cancel the Command Center subscription. You must cancel the subscription separately.
Except when law requires otherwise or BuildWithCory expressly agrees, paid fees are not refundable and partial periods are not credited. BuildWithCory can change future prices with reasonable advance notice. A price change does not alter an already paid period.
Ownership And Feedback
BuildWithCory and its licensors own the service, software, design, documentation, and related intellectual property. Subject to these Terms, BuildWithCory gives you a limited, revocable, nonexclusive, nontransferable right to use the service for your internal business operations.
You may provide feedback. BuildWithCory can use feedback without payment or restriction, but will not treat your confidential customer data as feedback. No right to Thumbtack or another provider property is granted.
No Guarantees And Warranty Disclaimer
The service is provided on an as is and as available basis. To the fullest extent permitted by law, BuildWithCory disclaims implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
BuildWithCory does not guarantee uninterrupted access, data accuracy, provider compatibility, account standing, provider consent, lead volume or quality, message delivery, customer response, appointment booking, charge accuracy, refund eligibility or approval, business revenue, legal compliance, or recovery from a provider restriction. Drafts and AI output can be incomplete or wrong and require your review.
Nothing in these Terms excludes a warranty or remedy that applicable law does not allow the parties to exclude.
Limits On Liability
To the fullest extent permitted by law, neither BuildWithCory nor its suppliers will be liable for indirect, incidental, special, exemplary, punitive, or consequential damages, or for lost profits, lost revenue, lost business opportunity, lost leads, lost goodwill, loss of provider access, or loss of data, even if advised that such harm was possible.
To the fullest extent permitted by law, the total direct liability of BuildWithCory for all claims arising from the service or these Terms will not exceed the greater of one hundred dollars or the service fees you paid to BuildWithCory during the 12 months immediately before the event giving rise to the claim.
The exclusions and cap do not limit your payment obligations, either party's indemnity obligations, your misuse of BuildWithCory intellectual property, or liability that law does not allow to be limited. BuildWithCory cannot rely on the cap for its fraud, willful misconduct, gross negligence, or knowing breach of its confidentiality or data security obligations.
Narrow Indemnity
You will defend and indemnify BuildWithCory from a third party claim, damage, judgment, or reasonable legal cost to the extent it results from your unlawful or unauthorized use of the service, your breach of the provider authorization or customer data duties in these Terms, your customer communication or professional service, or content you supplied that violates another person's rights.
This duty does not apply to the extent the claim results from BuildWithCory fraud, willful misconduct, gross negligence, or breach of these Terms. BuildWithCory must give prompt notice, allow you reasonable control of the defense, and provide reasonable cooperation at your cost. You may not settle a claim in a way that admits fault by BuildWithCory or imposes a payment or nonmoney duty on BuildWithCory without written consent.
Suspension And Termination
You can stop using the service and cancel the subscription as described above. You remain responsible for charges incurred before cancellation.
BuildWithCory can suspend or terminate access immediately for a security threat, suspected unauthorized account use, provider restriction, legal requirement, nonpayment, material breach, prohibited use, or conduct likely to harm a customer, provider, BuildWithCory, or another user. When practical, BuildWithCory will provide notice and a reasonable chance to cure a fixable breach.
Upon termination, your right to use the service ends and automation stops. Sections concerning fees owed, ownership, warranty, liability, indemnity, disputes, and other provisions that should reasonably survive will survive. Data handling and deletion follow the Privacy Policy.
Changes To These Terms
BuildWithCory can update these Terms for future use when the service, providers, risk, or law changes. The updated page will show a new date. BuildWithCory will provide reasonable notice before a material change applies. When the service presents a renewed acceptance control for a material update, the update will not apply to your continued use until you affirmatively accept it. A change will not retroactively remove a claim that already arose when the change took effect.
Arizona Law And Court Venue
Arizona law governs these Terms without regard to conflict of law principles, except when federal law controls. Before filing a lawsuit, each party will send a written description of the dispute and requested resolution and allow 30 days for a good faith effort to resolve it.
Any lawsuit arising from these Terms or the service must be brought in a state court located in Maricopa County, Arizona, or the United States District Court for the District of Arizona, and each party consents to those courts. These Terms do not require arbitration. Either party can use an eligible small claims court. Nothing prevents either party from seeking urgent court relief for a security threat, misuse of credentials, or intellectual property violation.
Miscellaneous
These Terms and the Privacy Policy are the entire agreement about the service and replace prior discussions about the same subject. If a provision is unenforceable, it will be narrowed only as much as needed and the rest remains effective. A failure to enforce a provision is not a waiver.
You may not assign these Terms without written consent. BuildWithCory can assign them as part of a service sale, reorganization, or transfer if the successor accepts the applicable obligations. BuildWithCory is not liable for a delay caused by events beyond reasonable control, but will use reasonable efforts to restore service.
Headings are for convenience. Electronic notices can be sent to the email associated with your account or shown in the service. You are responsible for keeping your contact information current.
